That the minutes of the meeting held on 12 and 14 May 2025 be agreed as a correct record and signed by the Chairman.

Minutes:

Cllr P Dowd disclosed a non-pecuniary interest in application 24/10522 and explained that he is a member of the Hythe and Dibden Parish Council, however he is not a member of their Planning Committee. He had therefore not participated nor passed comment on the application. He concluded that there were no grounds under common law to prevent him from remaining in the meeting to speak and to vote.

 

Cllr M Wade disclosed a non-pecuniary interest in application 24/10522 and explained that the application site was in his Ward and that he was also a member of the Hythe and Dibden Parish Council. However, he had not participated in the Parish Council’s Planning Committee, nor had he passed comment on the application. He concluded that there were no grounds under common law to prevent him from remaining in the meeting to speak and to vote.

RECOMMENDED:

 

Delegated Authority be given to the Service Manager (Development Management) to GRANT OUTLINE PLANNING PERMISSION subject to:

 

i)               the prior completion of an agreement pursuant to Section 106 of the Town and Country Planning Act to secure the matters set out in the report: and

 

ii)              the imposition of the conditions set out in the report and any additional / amended conditions deemed necessary by the Service Manager (Development Management), having regard to the continuing Section 106 discussions to ensure consistency between the two sets of provisions.

Comment

 

The Presenting Officer referred Members to the written update sheet and provided a verbal update to correct a sentence in the report, where on page 35, paragraph 6.12.10, the second line should read ‘maximum’ not ‘minimum’. 

 

The Presenting Officer also explained that this application should be considered with regard to the new planning context, including the new Ringwood Neighbourhood Plan and how the Affordable Housing Offer had changed since March 2023.  

 

Decision: 

Delegated Authority be given to the Service Manager for Development Management to GRANT OUTLINE PERMISSION subject to the completion of the Section 106 Agreement and any associated Agreement to secure the delivery of off-site community facility space provision and the conditions as set out in the report.

The Case Officer provided an update, in reference to condition 3, to clarify that it should read as follows:  

 

3. The approved South Eastern Footway Link between the Crow Arch Lane S278 works and the North Plot’s Southern Access subject of condition 16 of outline consent 13/11450 and the associated S278 agreement must remain available for use at all times. 

 

Decision: 

Delegated Authority be given to the Service Manager Development Management to GRANT PERMISSION subject to:  

 

  1. the completion a planning obligation entered into by way of a Section 106 Agreement or Deed of Variation to the principle S106 agreement dated 31st July 2014 as varied by Deed of Variation dated 12th February 2018 to secure :  

 

1) A financial contribution of £57,000 to be used for the provision of an east - west link from the site or for other sustainable transport measures to provide and/or improve connectivity between the site and Ringwood Town Centre.  

 

2) Dedication of land to HCC Highways along the eastern boundary of Crow Arch Lane from the allotments access to Yarrow Lane that is required for the implementation of a north-south 3 m shared pedestrian and cycleway link (to be identified on an approved plan) within 3 months of the completion of the legal agreement.  

 

3) Construction to HCC approval of the north-south 3m shared pedestrian and cycle way identified on an approved plan if not implemented in full by others within 5 years of the completion of the legal agreement.

Variation of condition 2 of Planning Permission 09/94047 to enable any marine-related business to operate from the units within the Boatyard and to allow for the repair and servicing of boats, irrespective of where they are berthed or how they are transported to and from the site.

A statement by Mr Russell Dyer was circulated to all members prior to the meeting. 

 

The Presenting Officer provided a verbal update relating to four additional representation letters received, reiterating concerns about amenity, highways implications, conflict with previous appeal decision and concerns about commercial activity associated with site.

To grant subject to the amendment of Condition 1 and the removal of Condition 2 as agreed by the Committee. 

 

Conditions/Reasons: 

Condition 1 as set out in the report was amended to reflect members’ concerns on the transportation of boats to the site overland. Condition 2 within the report was also removed to reflect the Committee’s view that the transportation of boats to the site overland could be harmful to the immediate area and would adversely impact the amenities of the area. 

 

The amended condition would now read: 

 

 

  1. The buildings shall only be used by marine-related businesses falling within Use Class E(g) or for the servicing and repair of boats normally berthed at Hythe Marina and for the servicing and repair of boats which arrive at and depart from Hythe Marina  by sea and for no other purpose, including any other which might have otherwise been allowed by the Town and Country Planning (Use Classes) Order 1987 (as amended) or Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended). Reason: To safeguard the amenities of residential properties at Hythe Marina in accordance with Policy ENV3 of the Local Plan 2016-2036 Part One: Planning Strategy for the New Forest District outside of the National Park.
