At the conclusion of this part of the Agenda, the Chairman of the Committee will move the following resolution:-

 

"That, under Section 100(A)(4) of the Local Government Act 1972, the public and the Press be excluded from the meeting for the following item(s) of business on the grounds that it/they involve(s) the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 12A of the Act and the public interest in maintaining the exception outweighs the public interest in disclosing it."

Appeal Against Dismissal

To consider an appeal against dismissal by this Council.

The Panel considered the oral evidence submitted by the appellant and the oral and written evidence submitted by the management.

 

There is a confidential minute on this item.

 

RESOLVED:

 

(a)         That, on the evidence available to the disciplinary hearing on 31 August 2017, the decision to summarily dismiss the appellant was correct; and

 

(b)         Having considered all the relevant factors, including alternatives to dismissal, the Panel was satisfied that, on the evidence before them, the decision to summarily dismiss the appellant was correct.  The decision to summarily dismiss the appellant was accordingly confirmed.
