Election of Chairman

To elect a Chairman for the meeting.

RESOLVED:

 

That Cllr Wappet be elected Chairman for the meeting.

Declarations of Interest

To note any declarations of interest made by members in connection with an agenda item.  The nature of the interest must also be specified.

 

Members are asked to discuss any possible interests with Democratic Services prior to the meeting.

11.

Exclusion of the public and the press

At the conclusion of this part of the Agenda, the Chairman of the Committee will move the following resolution:-

 

"That, under Section 100(A)(4) of the Local Government Act 1972, the public and the Press be excluded from the meeting for the following item(s) of business on the grounds that it/they involve(s) the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 12A of the Act and the public interest in maintaining the exception outweighs the public interest in disclosing it."

RESOLVED:

 

That, under Section 100(A)(4) of the Local Government Act 1972, the public and the Press be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in paragraph 1 of Part I of Schedule 12A of the Act and the public interest in maintaining the exception outweighs the public interest in disclosing it.

 

 

12.

Appeal Against Dismissal

To consider an appeal against dismissal by this Council.

 

 

Minutes:

The Panel was advised that the Appellant had indicated that he was unable to attend.  He had been given the opportunity to submit further representations in writing, to support his case, and had done so.  This additional evidence had been circulated to the Panel and to the Management.  The Appellant had also been offered an alternative venue for the Hearing but had declined the offer.  He had confirmed that he was happy for the Hearing to continue in his absence.

 

There is a confidential minute setting out the details of the matter.

 

RESOLVED:

 

(a)         That the Panel is satisfied, on the evidence before them, that the decision to dismiss the Appellant on the grounds that he was no longer capable of fulfilling his duties was correct;

 

(b)         That in reaching the conclusion above, the Panel emphasises that there had been no other concerns with the Appellant’s ability to carry out his duties, or his attitude within his employment.  The Council would remain happy to consider the Appellant for employment in the future should a suitable post become available.
